NY Ends Religious Exemptions for Vaccines, Violating Constitutional Rights of Millions

In a shocking blow to both health and religious freedom, New York governor Andrew Cuomo signed a bill Thursday to end religious exemptions to vaccines

In a disturbing turn of events, the NY House and Senate versions of the bill, A2371 and S2994A, respectively, to strip religious exemptions, passed in rapid succession on Thursday, despite the fact that NY legislators took an oath to uphold the Constitution; namely, the NY Const Art. I, § 11 states that,

No person shall be denied the equal protection of the laws of this state or any subdivision thereof. No person shall, because of race, color, creed or religion, be subjected to any discrimination in his or her civil rights by any other person or by any firm, corporation, or institution, or by the state or any agency or subdivision of the state."

The new law essentially prohibits healthy unvaccinated children from going to school due to their religious beliefs, and hence violates their parents' Constitutional right to opt out of vaccination; a medical intervention which carries with it the risk of death and disability, and which therefore requires the medical ethical principle of informed consent to be obeyed. 

NPR quoted Cuomo as stating, shortly after signing the bill:

The science is crystal clear: Vaccines are safe, effective and the best way to keep our children safe. While I understand and respect freedom of religion, our first job is to protect the public health and by signing this measure into law, we will help prevent further transmissions and stop this outbreak right in its tracks."

Nowhere did Cuomo, nor any of the other lawmakers who passed the bill, mention the over $4 billion dollars the federal government has paid out to victims of vaccine injury through the National Vaccination Injury Compensation fund, inaugurated in 1986 by an act of Congress. As many protestors have echoed, "where there is risk, there must be a choice!"

The New York Assembly required 76 votes to pass the bill, narrowly pushing it through wiht a 77-53 vote. Lawmakers in the state Senate approved the measure by a tally of 36-26.

One of the dissenting assemblymen, Long Island Republican Michael Montesano, described the bill as an "an attack on people's First Amendment rights. It's still the individual parent, who is raising this child, that has the fundamental right to decide what happens with their child in all facets of their life."

Perhaps even more concerning is a statement released by the American Medical Association on Thursday that it would focus its efforts to "incentivize states to eliminate nonmedical exemptions." The AMA is pushing to allow minors to consent to vaccinations (the equivalent of being medically penetrated) even if their parents refuse -- the subject of another bill pending in New York.

How Did They Push This Bill Through? 

First, they present a false narrative about the presumably 'deadly nature of measles infection'. As we have reported on, previously, measles is not only a relatively benign childhood infection, but it may confer certain health benefits, as confirmed by the peer-reviewed scientific literature itself.

Moreover, despite popular misconceptions, the MMR vaccine actually infects recipients with a strain of measles that has been proven to transmit to others - a fact that runs diametrically opposed to the narrative that the un-vaccinated are causing infections in the vaccinated. Thirdly, they ignore and/or actively suppress the fact that the concept of vaccine-induced herd immunity was derived parasitically from the natural fact that wild-type infectitious exposure will confer lifelong immunity to certain species.
